Kogi Guber: Party says Idris Wada is not PDP member

A Peoples Democratic Party (PDP) chieftain, Mr Emmanuel Abalaka on Monday, asked a Federal High Court in Abuja, Nigeria’s capital, to nullify the nomination of Captain Idris Wada as the party's governorship candidate for the December 3 election in Kogi state. 

In an originating summons brought pursuant to Section 31 (2) of the Electoral Act 2010 as amended, Section 31 (5) (6) of the electoral Act on the inherent jurisdiction of the court, the plaintiff wants the court to declare that Wada's nomination by the PDP is null, void and of no consequence. 

False claim of party membership

Abalaka wants an order disqualifying Wada from contesting the December 3, 2011 governorship poll and an order restraining the Independent National Electoral Commission (INEC) from recognizing Wada's candidacy in the poll. 

PDP and INEC are joined as respondent alongside Wada in the suit brought by Abalaka through his counsel Bola Aidi.  Buttressing why Wada cannot be a candidate in the said poll, the plaintiff said he was not a card carrying member of PDP by the time he was nominated alleging that he falsely claimed party membership on oath.

“The defendant (Captain Wada) has occasioned a mischievous and violent insertion of his name in the membership list of the 2nd defendant (PDP) in ward one, contrary to the electoral Act 2010,” Abalaka claims..

 In a 19 paragraph affidavit deposed to by the plaintiff himself, he maintained that the PDP wrongfully nominated Captain Wada as its candidate in the gubernatorial election. 

He further alleged that Captain Wada forged membership card of PDP to participate in the primary election conducted in the state.  He stressed that Captain Wada’s insertion of his name in the register was an action that cannot confer membership of the party on him. 

Besides, he alleged that Wada made false declaration that he attended Federal Government College Sokoto between 1969 and 1970 and the Nigeria College of Aviation Technology in the same 1969 and 1970.

The matter was adjourned to November 22, 2011 for hearing.
